Theoretically, India has a broad framework to deal with food adulteration, but there are numerous issues in its effectiveness and implementation. It is seen from the report that 25% of the total food tested by the FSSAI in 2018-19 were adulterated. Apart from this Indian food products have a high import rejection/refusal rate.
In the present era, adulteration of food can be done in each stage of the manufacturing process. Thus, it becomes a layered offence. Some states like Orissa, Uttar Pradesh, West Bengal and Madhya Pradesh punish offenders with life imprisonment. This has been recommended by the 264th Law Commission Report along with other measures to eliminate the discrepancies between the IPC and FSSA.
